How it is calculated
From 1 January 2020 to 31 December 2024, with confirmed annual pay of €36,500: 60 months and €100/day. Objective dismissal: 60 × 20/12 = 100 days, giving €10,000 gross, below the 360-day cap. Unfair dismissal: 165 days and €16,500 gross.
Objective or collective dismissal: 20 days per year, capped at 360 salary days. Unfair dismissal: 33 days per year, capped at 720; for contracts that began before 12 February 2012, the calculation uses 45 days per year through 11 February and 33 from 12 February. If the earlier segment alone exceeds 720 days, it sets the limit, with no addition for the later segment and an absolute cap of 1,260 days.
Annual pay is divided by 365, even in a leap year. Exact fractions are kept until the final amount is rounded to the nearest cent, half up. The rounded daily figure shown is not used as the multiplier.
Any remaining part of a month counts as a full month. The two transitional periods are calculated separately, so their total can exceed the full-period count by one month.
What is not included
This is not net pay or a guarantee of entitlement. It excludes final settlement, back pay during proceedings, taxation and enhanced contractual amounts.
